Sentencing in Idaho Falls
A Pocatello man has been sentenced to between 12 and 30 years in prison following his conviction on charges of child molestation and possession of thousands of child sexually exploitative images. Lukes Birch, 24, received the sentence Tuesday from retired Senior District Judge Joel Tingey in Idaho Falls.
Birch pleaded guilty in March to one felony count of lewd conduct with a child under age 16 and one felony count of possession of child sexually exploitative material. He initially faced 10 felony counts of possessing such material and one count of lewd conduct with a minor. Under the terms of his plea agreement, the remaining charges were dismissed.
According to court records, Birch possessed more than 4,000 pictures and videos depicting child sexual abuse. At least one of the images featured a child victim unrelated to the direct assault case.
Impact on Victim
The victim in the case was a young child at the time of the assault and has since experienced severe trauma. The child has been diagnosed with post-traumatic stress disorder, clinical depression, and anxiety. Additionally, the victim suffers from severe cerebral palsy, autistic tendencies, and generalized developmental delays.
Since the assault, the victim has attempted suicide twice. Following the initial abuse, the child was placed in a mental health facility for care and treatment.
The victim submitted an impact letter to the court describing the lasting effects of the abuse. “Since the assault, my life has changed in ways that are hard to explain. I struggle with feelings of fear, sadness, anger, confusion, hatred, suicidal thoughts, and anxiety,” the victim stated in the written statement read at sentencing.
The victim’s mother also submitted an impact letter to the court, adding her perspective on the harm caused to her child.
Prosecution’s Statement
Prosecutor Jeff Nye emphasized during the hearing the broader harm caused by the possession and distribution of such material. Nye noted that one of the videos in Birch’s collection featured a child victim from outside the immediate case, highlighting how such exploitation extends far beyond individual assaults.
“I just want to emphasize how much that child who’s featured in that video is not helpless,” Nye said. “There are men across the country, including the defendant, who are using this video of her most vulnerable moment for their own sexual gratification.”
Penalties and Registration
In addition to his prison sentence, Birch is required to register as a sex offender. He has also been ordered to pay at least $3,591 in court fines and fees.
The sentence imposed—12 years fixed with an additional 18 years indeterminate—carries a maximum potential of 30 years. Idaho law allows judges discretion in setting both fixed and indeterminate terms, with the indeterminate portion subject to parole eligibility determinations by the state’s prison system.
Cases involving child sexual abuse material and molestation of children with severe disabilities have drawn increased prosecutorial attention across Idaho in recent years. Similar cases have resulted in negotiated plea agreements when circumstances warrant consideration of victim protection and prosecution resource allocation.
What Comes Next
Birch will begin serving his sentence in the Idaho Department of Correction. As a registered sex offender, he will be subject to lifetime supervision requirements upon release. The victim will continue to receive mental health services as part of the aftermath of the case.
